General Terms and Conditions (AGB)

1. Scope of Application

These General Terms and Conditions are based on Swiss law and apply both within Switzerland and for deliveries abroad. They govern all business relationships resulting from purchases via the online shop (www.maisonelbaz.com), as well as for purchases where Maison Elbaz declares these terms to be applicable.

Changes and side agreements are only valid if confirmed in writing by Maison Elbaz.

Maison Elbaz reserves the right to modify these terms and conditions at any time without prior notice. The version published on the website at the time of the order is binding.

By placing an order, the customer acknowledges and accepts these General Terms and Conditions.

2. Offers and Contract Conclusion

All offers in the online shop are non-binding invitations to the customer. By placing an order, the customer submits a binding offer to conclude a purchase contract. Upon receiving an order, we will send an email confirming receipt and listing the order details (order confirmation). This confirmation does not constitute acceptance of the offer. The purchase contract is only concluded upon delivery of the ordered goods.

Prices listed at the time of ordering are considered accepted. Later price changes or discrepancies during order processing cannot be taken into account. Information such as sizes, dimensions, and weights are approximate and do not constitute guaranteed characteristics.

Maison Elbaz reserves the right to cancel already placed orders at any time and will refund any advance payments immediately. There is no obligation to deliver goods at any time. Orders containing false registration details, particularly incorrect email addresses or postal addresses, will not be processed.

All sales to end customers are not permitted for commercial resale and are therefore prohibited. This also applies to vouchers, which are non-transferable.

3. Prices

Prices listed in the online shop are non-binding and subject to change at any time. The price at the time of order is binding. Technical changes, errors, and typographical mistakes are reserved.

4. Return Policy

Maison Elbaz commits to care and delivers goods of good quality. Items purchased can be requested for return within 14 days of delivery via contact form or email (info@maisonelbaz.com).

Conditions: The goods must be unused, undamaged, complete, and in original packaging. The return request will be reviewed first.

  • In case of dissatisfaction or incorrect order: If the product is in its original, undamaged packaging but does not meet customer expectations, it may be returned. The buyer bears the burden of proof (via tracking number) and shipping risk.
    Important: In such cases, only a store credit (voucher) will be issued. Refunds are not possible.

  • In case of complaints: If you experience any issues such as non-delivery, transport damage, incorrect delivery, or defects upon use, report them with evidence via contact form or email.

The customer must inspect the goods upon receipt and report any defects in writing. If the package is damaged, this must also be reported immediately. If the customer does not report defects within 7 days, the goods are considered accepted and free of defects.

If Maison Elbaz is responsible for the defect, the full amount will be refunded within 14 days using the original payment method.

Warranty does not cover defects not caused by Maison Elbaz, such as natural wear and tear, force majeure, improper handling, interventions by the customer or third parties, excessive use, or environmental factors.

5. Disclaimer of Liability

Maison Elbaz assumes no liability for damage due to improper handling, natural wear and tear, or external influences, including self-installation of repair parts. Further claims by the customer, regardless of legal basis, are excluded.

We are not liable for damages unrelated to the delivered product itself. Installation and use of replacement parts or accessories are at the customer's own risk. Any resulting damages or voiding of warranties are the customer's responsibility. This includes injury during installation.

Maison Elbaz explicitly declares no influence over linked third-party websites and disclaims all responsibility for their content. This applies to all displayed links and their content.

6. Payment

Payment is accepted only through the following immediate payment methods:

  • Credit Card (VISA, Mastercard)

  • Apple Pay

  • Google Pay

  • PayPal

  • Twint

7. Delivery and Shipping

The estimated delivery date is shown on the respective product page. Delivery generally occurs within 7 to 21 business days after payment is received.

Prices are in Swiss Francs (CHF) and include VAT. Packaging and shipping costs are CHF 7 (Switzerland) or CHF 11 (Europe). If the minimum order amount (before or after returns) is not met, the customer bears the shipping costs.

All ordered products are delivered to your home or specified address throughout Switzerland.

8. Our Products

Our products are manufactured abroad. We strive to present images, texts, and product descriptions as accurately as possible.

9. Privacy Policy

To process orders, Maison Elbaz stores personal data within the limits of the law. Data is handled with the utmost care and in accordance with privacy regulations. Maison Elbaz may use this data to verify its accuracy or perform credit checks. Data is stored exclusively for order processing and internal marketing purposes. Customers can opt out of marketing use at any time.

Maison Elbaz commits to treating your data with strict confidentiality and only shares it with third parties for order fulfillment.
